Joel Ario Discusses Potential Health Law Repeal with Law360

June 28, 2012 – Manatt’s Joel Ario, a managing director with Manatt Health Solutions, spoke to Law360 about the possibility that the health reform law, which was upheld by the Supreme Court on June 28, 2012, may be repealed.

According to Law360, there is a possibility that Congress could repeal or defund all or part of the health law. Republican leaders immediately reaffirmed their dedication to repealing the law in its entirety. Since Democrats still control the Senate and the White House, Republicans will have a better chance of repealing the law if they sweep Congress and the presidency in the November elections.

However, the healthcare industry largely backs the Affordable Care Act and is unlikely to support its repeal. Industry support is beneficial to making things happen in Congress.

“Folks saying, ‘Let’s repeal the law’ will have little or no stakeholder support. There’s not a number of companies standing behind Speaker Boehner, making it really different from other issues,” said Ario, who is the former director of the U.S. Department of Health and Human Services Office of Health Insurance Exchanges. “Here the interest groups all pretty much have a lot to gain.”
