Representative Matters

Obtained summary judgment on behalf of a national medical products company with respect to claims by a terminated employee for breach of express and implied contract, national origin and age discrimination, intentional infliction of emotional distress and related claims.  The ruling was obtained after defeating an attempt by opposing counsel to amend the complaint to add a host of new causes of action involving the whistleblower statute that would have significantly expanded the scope of the lawsuit.

Obtained summary judgment on behalf of a state agency in federal court with respect to claims by an ex-employee alleging discrimination pursuant to the Family and Medical Leave Act and related claims to disability discrimination.

Negotiated a very favorable settlement of three state-wide wage and hour class actions after coordinating three separate law suits, obtaining the removal of the most aggressive plaintiffs' law firm because of conflicts,  and positioning the case with aggressive fact development and the streamlining of discovery.

Provide ongoing, high-level strategic advice to Boards of Directors and management teams with respect to such sensitive and challenging situations as alcoholism and drug abuse by high level executives, threats of violence in the workplace, and harassment allegations aimed at key business contributors.

Obtained dismissals of complaints being pursued by the U.S. Department of Justice and Civil Rights Division's Office of Special Counsel with respect to allegations of an ex-employee which included age, national origin and citizenship-related discrimination.

Negotiated quick and efficient resolutions of threatened litigation with respect to a wide variety of potentially dangerous discrimination, harassment and related allegations on behalf of clients through effective and aggressive fact development and communications with opposing counsel, thereby cutting off actual litigation and potential future claims.

Work with management teams of clients in a wide variety of industries on an on-going basis to develop down-sizing and termination strategies, high level executive employment agreements, and appropriate internal policies and procedures to reduce potential legal exposures.

Work repeatedly with government agencies, including the United States Equal Employment Opportunity Commission, the California Department of Fair Employment and Housing, and the United States Department of Labor, to achieve resolutions of claims allegations to the benefit of clients.

Provide regular training to management teams and high-level executives with respect to management best practices to reduce employment litigation exposures.

Effectively and aggressively utilize alternative dispute resolution mechanisms to achieve early resolutions of lawsuits.

Utilized by clients to provide ongoing advice and oversight regarding the handling of the defense of their employment lawsuits by insurance companies and/or their panel counsel.
