Robert Shulman is a partner in the Litigation Division in the Washington, D.C., office specializing in insurance recovery. He litigates complex disputes with insurance companies on behalf of corporations seeking coverage for claims involving environmental issues, products, construction, directors and officers, asbestos, and other large-scale torts. He also handles insurance claims related to securities, natural disasters, and business interruption losses.
In addition to his insurance recovery practice, Mr. Shulman is experienced in class action litigation, including opposing certification as well as the development and implementation of both certification and the merits.
Mr. Shulman's experience spans state and federal courts throughout the United States and adjudicative bodies in the United Kingdom. He has represented clients in cases designated for multidistrict coordination, and has considerable experience in alternative dispute resolution in a wide range of matters.
Mr. Shulman served as a law clerk to the Honorable George Arceneaux Jr., U.S. District Court for the Eastern District of Louisiana from 1979-1981. In 1981, he served as an attorney for the Securities and Exchange Commission's Office of General Counsel.
International Paper Co. v. Affiliated FM Ins. Co., et al. Represented International Paper against 22 of its insurance carriers in a nationwide products liability class action. The first phase of the case resulted in a $93.2 million jury verdict in International Paper's favor. The trial of the second phase returned a $383.3 million verdict in International Paper's favor.
Products Class Actions. Represented International Paper in court supervised mediations resulting in the settlement of three large nationwide class actions.
MBIA Inc. v. Federal Insurance Co. Represented MBIA in a landmark case obtaining substantial defense costs in D&O insurance cases arising out of shareholder, SEC and NYAG actions.
FDIC. Currently represents the FDIC in seeking insurance and other sources of recovery in connection with ban k closings.
In re: Methyl Tertiary Butyl Ether (MTBE). Represented Hess Corporation in actions concerning MTBE in product liability litigation.
Consolidated Dryer Fire Litigation. Represents Electrolux in multistate subrogation claims linked to alleged product defect as well as related insurance coverage issues.
State Farm v. Electrolux. Represents Electrolux in opposing attempted subrogation and aggregation of dozens of individual product liability claims.
Thorogood v. Sears, Roebuck & Co. Represented Electrolux and Sears in opposition to a writ of certiorari before the U.S. Supreme Court that erroneously sought certification of a putative class-related action.
Mutuvi v. Electrolux. Represented Electrolux in an appeal of a significant jury verdict involving a product liability lawsuit as well as mediation resulting in settlements with claimant, Electrolux, and an insurance company.
Amerada Hess Corp. v. Travelers Indemnity Co.; Amerada Hess, et al. v. Zurich Ins. Co., et al. Represented Hess Corporation in a number of environmental insurance coverage disputes, including a case of first impression regarding the application of a pollution exclusion to an industrial accident.
DuPont. Provided representation in two international arbitrations regarding insurance coverage for fungicide-related crop damage.
Fuisz v. Selective Insurance Co. of America. Represented a policyholder in a landmark case for insurance arising out of alleged defamation.
