With Deepfakes on the Rise, Victims Need a Nimble Legal Strategy

Manatt Entertainment Partner Nathaniel Bach wrote an article for Bloomberg Law outlining key strategies and tools that individuals and corporate victims of harmful deepfakes can utilize to take legal action and protect their reputations.  

Bach discussed the importance of coupling targeted litigation with takedown demands, and understanding the benefits and limits of state and federal laws applicable to malicious deepfakes. Bach also highlighted the importance of working closely with federal and local law enforcement authorities and public relations experts. 

In addition, Bach noted key pending legislation including the NO FAKES Act and the No AI FRAUD Act and an anticipated rule from the Federal Trade Commission that would target the sources of deceptive AI deepfakes.
