Defending national retailer against multiple consumer privacy class actions
Manatt attorneys have defended a national retailer against multiple class actions alleging violations of consumer privacy. As part of that litigation’s defense, we obtained several rulings on issues of first impression, including the methodology for determining jurisdictional dollar minimums to obtain Class Action Fairness Act jurisdiction, and a ruling that jury trials are not available under the Song-Beverly Credit Card Act. The class actions resulted in favorable settlements, including one of the first judicial approvals of a coupon-based settlement under the Class Action Fairness Act.
