Manatt secures major victory for SMART

Yeh v. International Ass’n of Sheet Metal, Air, Rail & Transportation Workers Union (Superior Court of the District of Columbia). Manatt secured a complete victory for SMART, the International Association of Sheet Metal, Air, Rail and Transportation Workers (which is comprised of approximately 700 local unions and councils in the United States, Canada and Puerto Rico) in connection with a multi-count complaint filed by a former employee alleging sexual harassment, a hostile work environment and retaliation. Following a protracted and contentious discovery period, the court imposed sanctions against the plaintiff, ordered her to pay the client Manatt’s attorney fees to bring the motion and ruled that a negative inference be read at the trial due to plaintiff’s destruction of evidence. The court granted Manatt’s motion for summary judgment in its entirety and dismissed SMART from the case.
