Law360 interviewed Manatt's Joel Ario, a managing director with Manatt Health, for an article on the healthcare industry's 2016 legal docket, which is filled with momentous litigation that will shape the future of False Claims liability, Affordable Care Act coverage and abortion rights.

Law360 reports that the industry will be closely following a U.S. House of Representatives lawsuit that challenges billions of dollars in cost-sharing subsidies under the ACA. Industry insiders have begun to question how exactly the subsidies would be affected by a House victory, given that the ACA says that insurers "shall reduce the cost-sharing" of eligible consumers, suggesting that reductions are mandatory, regardless of whether Congress appropriated money to reimburse insurers.

"The subsidies would not go away. There would still be an obligation of the insurers," Ario said.
