Public Private Partnerships
With the public pushing for investment in innovative transportation solutions, there are big opportunities in lucrative public-private partnerships, but also myriad legal issues to address. Peninsula Humane Society & SPCA (PHS/SPCA). PHS/SPCA needed to build a new home for its animal adoption services; however, the project was at a virtual standstill due to eight lawsuits that were filed by well-funded, neighboring property owners trying to stop it. Manatt attorneys had coordinated the successful defense of those lawsuits, including on appeal, and the sale of the property in question closed within 14 months of our being retained. PHS/SPCA broke ground on construction of its facility in 2009.
Union Pacific Corp. We represented Union Pacific in five related lawsuits connected to the proposed reconstruction of a section of the I-880 freeway in Oakland, Calif., following structural damage caused by the Loma Prieta earthquake. The cases included three condemnation suits, a quiet title action and a breach of contract suit.
Anthony Forest Products Co. We are special counsel to Anthony Forest Products Co., a leader in the engineered wood products sector, in a construction defect action brought by LPC Union Apartments, the developer of an apartment project in downtown Los Angeles, against our client and dozens of other defendants.
Local Historical Trust and Prominent Recording Artist. On behalf of a local historical trust and a prominent recording artist, we filed an action in a California state court against an out-of-state property developer that we claimed violated a restrictive covenant in its construction of a large commercial complex. The case went to mediation, where we convinced the developer to make all nine of the construction/design changes required by the covenant.
Turkish Construction Company. Our lawyers successfully resolved a criminal investigation of a Turkish construction company in connection with a very high-profile project—a new park in Manhattan—that the company is building.
