Manatt appellate partner Benjamin Shatz authored an article for Daily Journal about the Y2K Report of the Appellate Process Task Force—commonly called the Strankman Report—and how its five recommendations changed the appellate practice over the past two decades—or not. In the article, Shatz discussed each of the five recommendations with an eye towards explaining how they have helped the Courts of Appeal “fulfill their constitutional mandate with greater speed and efficiency without additional expenses and without sacrificing fundamental decision-making values.” Shatz also noted that “significant change is hard,” but that the appellate practice’s response to the COVID-19 pandemic proved that “when push comes to shove, the appellate system can adapt effectively and nearly instantaneously.”
