Manatt’s Matthew O’Loughlin, co-chair of the firm’s mergers and acquisitions practice, spoke to Natural Products Insider about how new leadership at the Federal Trade Commission could impact enforcement cases brought against the dietary supplement industry.
O’Loughlin noted that it will take some guesswork to understand how Joseph Simons, the antitrust lawyer selected to lead the FTC, will view the $41 billion U.S. dietary supplement industry. Simons is used to dealing with large pharmaceutical companies as opposed to smaller dietary firms.
“He’d likely be, as the [Trump] administration would hope, pro-competition, but not over-the-top from a regulatory perspective,” O’Loughlin told the publication.
