Banks Watch Top Court on Arbitration, Transfers, Whistle-Blowers

Bloomberg BNA quoted Manatt’s Richard Gottlieb, co-chair of the firm’s financial services group, on a trio of upcoming Supreme Court cases that will take up arbitration, allegation of fraudulent transfers and whistle-blower questions.
 
National Labor Relations Board v. Murphy Oil USA is one of several petitions fielded by the court
on whether workplace arbitration agreements that prohibit class actions violate federal labor laws. Gottlieb told the publication that the case is important for financial institutions because of its potential bearing on arbitration agreements, especially given the CFPB’s recent issuance of its arbitration rule.
 
“While strictly speaking
a labor case, the Federal Arbitration Act reflects the will of Congress to favor this forum, and the Supreme Court may use the suit to make expansive statements that could impact the negative CFPB arbitration stance,” said Gottlieb.
