Law360 quoted Manatt’s Lisl Dunlop, co-chair of the firm’s antitrust and competition practice, in an article on the top competition cases to watch in the upcoming year.
The publication noted that American Express is one of these cases. In October, the U.S. Supreme Court granted certiorari for a petition from a group of states seeking to reverse a loss in their enforcement action, which targeted the company for rules that prevent merchants from steering customers to other credit cards.
“Now that the issue of whether the government supported the cert petition is behind them, the government can come back in and make the case for reversal,” said Dunlop.
She also explained that a decision could have implications for companies in similar, multisided markets.
