Manatt’s Gregg Nunziata, a partner in the firm’s government and regulatory practice, provided insight into how newly seated Supreme Court Justice Brett Kavanaugh will engage with cases during his first term.
In the segment, Nunziata reviewed past and typical practices for newly confirmed justices, and what can be expected as Kavanaugh transitions into his new role.
“I think, in the first term, typically, traditionally, the newest justice is in a somewhat deferential role in the court,” said Nunziata. “He’s the one who closes the door to the chambers, he’s typically assigned, at least, in the first several opinions that he writes, some of the easier decisions, decisions that are more unanimous on the court.”
