CCPA Litigation Risks: How to Avoid Claims Under Other Statutes

Co-leader of Manatt’s privacy and data security practice Scott Lashway spoke with Cybersecurity Law Report about potential CCPA litigation risks companies may face following the law’s implementation on January 1, 2020. In the article, Lashway detailed consumer data requests companies have received and the risk of consumer class actions. He noted that many of the requests are delicately worded and cite the statute at length, which means they could come from “consumers who happen to work as lawyers, or plaintiffs’ lawyers investigating for a possible class action.” Lashway goes on to say, “I’ve also seen references to both CCPA and GDPR rights in the same request. I don’t think the average consumer would put together, and then differentiate in detail, CCPA versus GDPR.”
