EPA Emissions Goals Remain Viable Despite High Court Loss

Manatt's Craig Moyer, chair of the firm's Land, Environment and Natural Resources practice, spoke to Law360 about the U.S. Supreme Court's ruling that the federal Environmental Protection Agency's carbon emissions policy violates the Clean Air Act.

As reported by Law360, the EPA may have lost its bid to preserve its power to regulate greenhouse gas emissions through Prevention of Significant Deterioration and Title V permits, but the court's decision still allows the agency to require comparable greenhouse gas emissions reductions through an alternative permitting program.

"This is still a victory for U.S. EPA," said Moyer. "The process is still important, and the court put some limitations on that process, but the decision still gets them virtually all of what they wanted from an environmental perspective."
