Law360 interviewed Manatt's Craig Moyer, chair of the firm's Land, Environment and Natural Resources division, for an article on the eight state and city ballot initiatives that could have significant nationwide implications, should they pass or fail.

Law360 reports the voters in Denton, Texas, will weigh in on a topic that has been attracting national attention. The initiative, if passed, would ban hydraulic fracturing within Denton city limits, and it could have widespread impact as other cities and states across the country wrestle with the question of fracking.

Moyer told Law360 that energy companies would likely test the measure in court if it passes. "If this measure in Denton passes, it is likely to be challenged as overbroad and perhaps as a taking," he said. "Oil and gas developers take these measures seriously and need to continue to work with the public to ensure accurate information about their activities gets out there."
