    August 29, 2011 – Manatt’s Jon Costantino, a senior advisor in the firm’s Climate Change, Environmental & Clean Energy Policy Practice Group, was quoted by Platt’s Electric Utility Week on the California Air Resources Board’s support of the cap-and-trade system.

    Electric Utility Week, a publication for top executives and policymakers in the utility industry, reports that the California Air Resources Board (CARB) has affirmed its support for a cap-and-trade system to limit greenhouse gas emissions. The affirmation comes several months after San Francisco Superior Court Judge Ernest Goldsmith ruled that CARB did not sufficiently consider alternative policies. Since the ruling, CARB has expanded its analysis of other policies, but Costantino says cap-and-trade is still the board’s primary choice.

    “There are still steps to be done, but the board made a statement, saying that it still believes in cap-and-trade,” said Costantino. “If the governor had reservations, you probably would’ve heard something.”
