Profile

Matthew Stein is a special counsel in the firm’s Boston office and a member of the privacy and data security team. Before joining Manatt, Matt was a senior counsel at a global bank, and was on the bank’s privacy legal team advising on U.S. and international privacy laws such as the Gramm-Leach-Bliley Act (GLBA), the California Consumer Privacy Act (CCPA), the General Data Protection Regulation (GDPR) and the Telephone Consumer Protection Act (TCPA). In addition to his legal work, Matt knows technology from the other side: He’s also been a programmer and web app and SQL developer.

For more than 15 years, Matt has been helping companies and individuals in many industries find solutions and opportunities in a risk-sensitive manner.

  • In the privacy and security space, Matt has advised companies and individuals on privacy and security governance and compliance obligations and incident response, written privacy and security disclosures and internal policies, and negotiated data protection agreements and other data transfer agreements. For example, he has advised on the GLBA, the Health Insurance Portability and Accountability Act (HIPAA), the CCPA and its successor Consumer Privacy Rights Act (CPRA), the Colorado Privacy Act (CPA), the Virginia Consumer Data Protection Act (VCDPA), the TCPA, CAN-SPAM, the Children’s Online Privacy Protection Act (COPPA), and the online privacy and security laws of California, Delaware and Nevada (CalOPPA, DelOPPA and Nevada’s Chapter 603A). He has also advised on Europe’s GDPR and ePrivacy Directive, Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA), the Cayman Islands’ Data Protection Act (DPA), and Australia’s Privacy Act, among others.
  • In operational and compliance areas, Matt has helped companies anticipate their legal and reputational risk so as to mitigate risk and maximize business-as-usual operations. He has identified and advised on practical approaches to address legal and nonlegal business problems, using a hands-on approach to find cost-effective and actionable solutions. He frequently negotiates complex commercial contracts and writes playbooks, policies, procedures and process flow charts to improve corporate efficiencies.
  • In litigation, Matt has come in early, achieving favorable quick and cost-efficient results; and he has come in late and turned lawsuits around, shifting momentum and leading to positive outcomes. He has extensive experience representing companies in commercial litigation, including class actions and investigations. 
  • In mergers and acquisitions, Matt has advised clients on data protection aspects of acquisitions and divestitures and on litigation risk, pricing it to permit buyers and sellers to properly assess the materiality of such risk on the transaction. He also has advised and negotiated indemnification and related contractual issues.
  • In e-discovery, Matt has counseled clients on strategic approaches to discovery, identifying ways to protect clients’ litigation strategies while saving money in discovery costs and protecting clients’ private and confidential information.

Matt was named one of “Boston’s Future Leaders” by the Greater Boston Chamber of Commerce in 2014 and holds a CIPP/US certification from the International Association of Privacy Professionals. He is a former contributing editor to the annual Law of Class Action and editor of the Class Action & Derivative Suits newsletter, both published by the American Bar Association, and he contributed two chapters to the first treatise published on the Class Action Fairness Act.
