Manatt Entertainment Partner Sarah Moses, Advertising, Marketing and Media Associate Monica Kulkarni and Law Clerk Jacob Geskin wrote an article for Billboard on how brands can safely use copyrighted music on social media while ensuring that artists are appropriately compensated for their work.
In the article, the authors explored several recent lawsuits brought by music rights holders targeting brands for unauthorized use of music on social media platforms. They went on to discuss steps brands can take to avoid copyright infringement when using music owned by third parties, such as licensing the music directly from the rights holders and utilizing platforms’ commercial music libraries. “The rising chorus of lawsuits from music rights holders is nothing to tune out. Brands using music as part of their social media strategies (which, practically speaking, is almost every brand) must take proactive steps to mitigate legal risks, and they will also be protecting artists’ rights in the process,” they wrote.
