6 CFPB Areas To Watch In 2020

Manatt Financial Services partners Richard Gottlieb and Charles Washburn authored an article for Law360 on some key Consumer Financial Protection Bureau (CFPB) stories from 2019, as well as six trends to watch for in the coming year. In this article, Gottlieb and Washburn discuss various 2019 developments, including the upcoming Supreme Court case questioning the constitutionality of the CFPB’s structure, three new policies the CFPB finalized that are aimed at promoting innovation and facilitating compliance, and the organization’s efforts to improve its disclosures on civil investigative demands. They also expect 2020 to be active on the rulemaking front, noting the likely activity includes “proposed changes to the Remittance Rule, amendments to Regulation F regarding debt collection, a final rule rescinding the ability to repay provisions of the Payday Rule — estimated to arrive in April — and a final rule coming in March on the HMDA concerning the permanent thresholds for both open-end credit lines and closed-end mortgage loans.”
