CDC’s Eviction Ban and the Burn-Off of Eviction Moratoria

Manatt Real Estate partner Grace Winters, litigation partner Viral Mehta and government and regulatory partner Gregg Nunziata authored an article for Daily Journal about the expiration of certain moratoriums on residential and commercial eviction filings, including the residential moratorium enacted through the CARES Act. In particular, they discussed the impact the moratorium burn-off might have on the real estate industry as the COVID-19 pandemic continues to impact the country. The authors also highlighted the unprecedented action taken by the Centers for Disease Control and Prevention (CDC) to ban residential evictions for most renters until December 31, 2020, saying, “the CDC’s order will provide reprieve to some residential renters, and it will afford Congress and local governments a window to pass new legislation to address this growing problem, including financial assistance to both renters and property owners.”
