Manatt land use Partner David Smith authored an article for Daily Journal on the regulatory cycle between presidential administrations and its impact on environmental regulation. In particular, Smith noted that the use of executive orders to build environmental protection regulations results in ever-changing regulations that are easily undone without congressional action, especially under the current administration. “The cycle of regulatory ping-pong every four or eight years is not new, but it seems especially pronounced (and absurd) today as we see the vice president from two administrations ago now seeking to redo what the last guy undid from what his prior boss did,” he added.
