Prop 65 Cannabis Warnings Provide Clarity, But With Conditions

Manatt Partners Peter Duchesneau and Anita Famili co-authored an article for Daily Journal, which detailed the California Environmental Protection Agency’s Office of Environmental Health Hazard Assessment’s (OEHHA) proposed modifications to its regulations for Proposition 65 safe harbor warnings to address cannabis and THC-containing products. “Tailored safe harbor Prop. 65 warning regulations can be advantageous for businesses by providing regulatory certainty to protect against lawsuits for a failure to properly warn,” the authors wrote. However, they cautioned that the cannabis industry should carefully inspect OEHHA’s planned rules to ensure that the warnings are appropriate and practicable to implement.
