What FTC's 'Penalty Offense Notices' Mean For Companies

Manatt Financial Services Counsel Joseph Reilly and Special Counsel Jonathan Joshua as well as consumer financial services practice Leader Richard Gottlieb authored an article for Law360 on the Federal Trade Commission's recent issuance of “notices of penalty offenses” to several hundred organizations, and the impact these notices might have on financial institutions and other companies. In particular, the authors highlighted that these notices are meant to call out unfair or deceptive acts or practices, noting they “make clear we can expect a newly emboldened and active FTC, seeking to stretch the limits of its authority to target established industry participants in connection with what may have formerly been considered business as usual.”
