Takings Day at SCOTUS

Appellate Senior Counsel Michael Berger wrote an article for Daily Journal discussing two recent takings law decisions out of the U.S. Supreme Court. The first case, Tyler v. Hennepin County, Minn., explored government confiscation of a property’s remaining equity after a foreclosure sale, while the second, Sackett v. EPA, addressed a long-running dispute on the extent of the government’s regulatory power under the Clean Water Act. Berger went on to explain the context and details of each case, as well as their implications surrounding similar disputes in the future.
