Tweets Not the Whole Story Behind Publicized NLRB Chipotle Ruling

The Pennsylvania Record interviewed Manatt's Alan Brunswick, a partner in the firm's Employment and Labor practice, for an article about a feud between Chipotle and a former employee over a highly-publicized employment matter.

Earlier this week, National Labor Relations Board (NLRB) Administrative Judge Susan Flynn ruled that the employee must be offered re-employment and offered back pay after his termination in February of this year. The story garnered attention due to the employee's tweets, according to the publication.

"The tweets are not why he was fired, but they are what has grabbed everyone's attention," Brunswick explained. Rather, the employee was terminated due to his collaboration with employees to confront management about work expectations when public transportation is closed due to inclement weather.

His collaboration with colleagues is what made it protected activity for NLRB, Brunswick said. "That's the hook that the NLRB has been using to go after nonunion employers."
