Manatt Secures Victory for L-3 Technologies in Serco Defense Subcontract Dispute

Manatt’s Nigel Wilkinson, a partner in the firm’s litigation practice; Andrew Zimmitti, a partner in the firm’s investigations and white collar defense practice; and Joshua Drian, an associate in the firm’s litigation practice, are representing L-3 Technologies in a dispute with Serco Inc. over an alleged $80 million scheme to remove L-3 from a U.S. Air Force subcontract.

L-3 scored a win on June 10 when the Fourth Circuit overturned a previous ruling that L-3’s conspiracy and fraud claims fell outside of relevant statutes of limitations, according to Law360.

L-3’s 2015 lawsuit alleged that Serco helped then-L-3 Services employees steal trade secrets and form a new business, Jaxon Engineering & Maintenance, and engaged in a “bid-rigging scheme” to direct its high-altitude electromagnetic pulse testing and maintenance-related work to Jaxon beginning in June 2009. Serco had originally entered into a subcontract with a now-defunct unit of L-3 in 2004.
