BlackRock Suit Highlights Antitrust Risks Of ESG
Manatt Partners and and Associate wrote an article for Law360 about an antitrust case brought against major institutional investors that shows the risks companies face when coordinating ESG goals, particularly in light of aggressive federal and state antitrust enforcement.
The lawsuit, originally brought by 11 Republican attorneys general in November and joined by two more in January, serves as a reminder that companies pursuing ESG goals need to be mindful of how antitrust law may affect their ability to pursue sustainable objectives.
“It is important for companies involved in pursuing ESG goals through investing to be mindful of the effect that federal antitrust law may have on their ability to pursue sustainability objectives that involve collaboration with competing investment companies or adoption of investment principles that are not voluntary or discretionary,” the authors wrote.
