Emily Whitely

Emily Whitely is a litigation associate in the Firm’s New York office. She represents companies in the technology, health care and consumer sectors in complex commercial disputes and litigation involving data privacy issues including putative class actions under state privacy statutes.

Emily’s practice spans high‑stakes business conflicts such as contract and post‑closing disputes, joint venture and shareholder matters and business torts and quasi-contract claims. She guides clients through every phase of resolution—from early case assessment and strategic motion practice to disciplined discovery, mediation, and arbitration, emergency relief, trial, and appeal.

In addition, Emily handles bankruptcy‑related litigation, advising clients on contested matters and adversary proceedings that intersect with commercial disputes. Her approach is pragmatic and business‑forward, incorporating clear risk framing, practical options and execution discipline that align legal strategy with operational goals, delivered in close collaboration with cross‑functional teams in regulated industries.

While in law school, Emily served on the Intellectual Property & Technology Forum journal as an articles editor, rounding out her interest in data privacy, health and technology. Before her legal career, Emily worked in the MedTech industry with a focus on business development and marketing.
