How Prepared Are You For Trump 2.0’s Worksite Enforcement Regime?

Manatt Investigations, Compliance and White-Collar Defense Partner  and Litigation Associate  were key authors of an article for Business Crimes Bulletin on the new administration's worksite enforcement regime and how employers can avoid scrutiny by preparing robust compliance policies and procedures.

The worksite enforcement by the U.S. Department of Homeland Security aims to enforce action against employers which hire unauthorized workers, including those which employ someone without complying with the employment verification process described in the Immigration and Nationality Act, according to the authors. Companies should take steps to help prevent worksite enforcement actions such as by creating a compliance program which includes periodic internal I-9 audits, Wolff and Athay noted. “Employers should prepare now to confirm their employees are authorized to work and have robust compliance policies and procedures in place should ICE come knocking,” the authors wrote.
