DOJ And EU Authorities Call Apple’s Security Defense Bogus

Manatt Antitrust and Competition Partner David Reichenberg wrote an article for Forbes about the antitrust claims and concerns that the Department of Justice (DOJ) and European Union (EU) have surrounding Apple’s security-based defenses to the antitrust claims against the company. 

The article discussed how the DOJ and EU believe that Apple’s security concerns are facades to maintain monopoly over the smartphone industry. Reichenberg dived into specific claims such as Apple’s restrictions on apps that prevent developers from creating software that can be easily used on all phones, in turn creating obstacles for users to switch brands. “The underlying premise behind both the US and EU’s critiques of Apple’s security-based claims is that they are being used opportunistically to shield itself from competition. The EU has passed legislation in an attempt to rein in Apple’s control over its ecosystem, and the DOJ has filed its monopolization lawsuit,” he said.
