Three Recent Artificial Intelligence IP Developments That You Need to Know

Manatt Entertainment Partner wrote an article for Daily Journal where he explored three important recent artificial intelligence (AI) intellectual property developments, including upcoming litigation and legislative fights.

In the article, Bach described how tech companies are seeking legislative copyright change, highlighting debates surrounding whether training AI models on copyrighted materials should be made a fair use, writing, “It merits closely watching the direction that the administration and Congress pursue on AI training, and whether any legislative efforts will gather steam.”

He also recapped one of the first fair use rulings in an AI copyright lawsuit, and the U.S. Copyright Office’s most recent guidance on when and whether generative AI-assisted works can qualify for copyright protection.
