Ex-Oriole Says Feds Hiding Evidence in Insider Trading Case

Law360 covered the latest update in an insider trading case against former Baltimore Orioles third baseman Doug DeCinces, who is represented by Manatt litigation partner Kenneth Julian, reporting that DeCinces claims federal prosecutors are withholding evidence that would clear him of insider trading allegations.

On behalf of DeCinces, Julian argued that prosecutors purposefully held back evidence that would contradict their appeal of the court’s decision to exclude evidence in regard to particular trades, in conflict with the Supreme Court's landmark 1963 Brady v. Maryland decision, which held that the government must disclose potentially exculpatory evidence in its possession.

The case is USA v. Mazzo et al., case number 8:12-cr-00269, in the U.S. District Court for the Central District of California.
