9th Circuit Split Proposal Buoyed by Political Shift

Law360 interviewed Manatt’s Ben Shatz, co-chair of the firm’s appellate practice, for an article about a renewed proposal to split apart the U.S. Court of Appeals for the Ninth Circuit.

Critics have long set their sights on the Ninth Circuit—the largest by geographic span, population covered and caseload—saying the federal appellate court at its core is left-leaning, slow to dispose of cases and frequently reversed by the Supreme Court.

“This discussion is political and has become political,” said Shatz. “This is probably the best time for the move to be made again and it has happened over and over again. It's not really surprising that it's happening.”
