Libby Named to List of Litigators of the Week by American Lawyer

Manatt’s John Libby, a leader of the firm’s investigations and white collar defense practice, was named a runner-up for Litigator of the Week by The American Lawyer’s Litigation Daily for his work on a lawsuit against U.S. Commerce Secretary Wilbur Ross’ decision to add a citizenship question to the 2020 Census.

Libby represented the City of San Jose in the lawsuit, which also included a number of other California cities. U.S. District Judge Richard Seeborg of the Northern District of California ruled that adding the census question was unnecessary and subjective, and violated the Administrative Procedure Act (APA).

This case was also the first on a state level to challenge the census question by citing the Enumeration Clause of the Constitution. A similar case in New York involved only APA claims.
