Virus Emergency Declaration Gives States Flexibility on Medicaid

Manatt Health senior managing director Patricia Boozang spoke with Bloomberg Law on how the Trump administration’s decision to declare a national emergency in response to the coronavirus pandemic will impact states seeking flexibility in their Medicaid programs through waiver applications. Specifically, Boozang noted that the administration’s decision to declare a national emergency will allow states to seek federal waivers under Section 1135 of the Social Security Act. She also highlighted that this declaration will allow states to utilize telehealth services to a greater degree than usual, which Boozang calls “a ‘critical tool’ in the effort to test and treat people without bringing them into a health-care setting where they could be exposed to or spread the virus.”
