Polaris Quoted by Law360 About CMS’ Request for Data from Gender-Affirming Care Providers

Manatt Health Partner  was quoted in a Law360 article discussing the implications of the Centers for Medicare & Medicaid Services’ (CMS) recent oversight letter requesting that hospitals provide detailed information and financial data surrounding their gender-affirming care services. 

Providers that continue to offer gender-affirming procedures are facing increasing pressure and these types of communications intensify scrutiny for clinicians. Under the new administration, an “atmosphere of fear” among providers has grown which seems to be designed to get providers to act a certain way without enforcing new requirements, according to Polaris. “It seems like, then, the game is to try and achieve preemptive compliance, where providers do what the government wants them to do without the government actually having to make them do it,” he said.
