Reilly Quoted in Daily Journal on Drip Pricing Litigation Surge

Less than two years after taking effect, California's Honest Pricing Law has generated what Reilly describes as an explosion of litigation targeting drip pricing—the practice of advertising part of a price and revealing mandatory charges later in the purchase process. Reilly has been closely tracking the growing wave of class actions and notes that judges are increasingly presuming consumer reliance on advertised prices, making early dismissals harder to secure, and that plaintiffs are extending claims beyond the Honest Pricing Law to allege claims under California's Unfair Competition Law and False Advertising Law.

“The law doesn't care if a fee is $1 or $100. It cares whether consumers saw it coming,” said Reilly.
