City of San Jose Seeks Supreme Court Review in Major League Baseball Case

Last week the City of San Jose petitioned the U.S. Supreme Court for review of the recent Ninth Circuit Court of Appeals decision upholding Major League Baseball’s antitrust exemption. Although such petitions face long odds, the Dean Emeritus of Santa Clara Law School, Donald Polden, has stated in the Op-Ed piece linked below that there are strong reasons why the Supreme Court should take the case. Dean Polden is also on the Board of Santa Clara University’s Institute of Sports Law and Ethics, which is chaired by Ron Katz, who also chairs Manatt’s sports law practice group.
