2023 Health Care Enforcement Trends: Spotlight on Consumer Protection, Antitrust and Fraud

In a recent speech, a senior official at the U.S. Department of Justice Antitrust Division noted that “in U.S. antitrust enforcement and competition policy, there is no more important question than what can we do to safeguard competition in the health care industry.” Consistent with this sentiment, 2023 has witnessed an increase in investigations and enforcement actions in the health care industry by state and federal law enforcers, including State Attorneys General, the Federal Trade Commission (FTC), and the Antitrust and Criminal Divisions of the Department of Justice (DOJ). Every indicator shows that trend will remain strong in 2024.

In a new webinar, Manatt will review the 2023 landscape of enforcement in health care by State Attorneys General, the DOJ and the FTC, focusing on consumer protection, antitrust and health care fraud. The CLE-eligible program will examine current trends, look ahead at what to expect in 2024 and share strategies for protecting your organization in an increasingly stringent enforcement environment. Key topics that will be covered include:

  • State Attorney General consumer protection enforcement trends, including major areas of focus:
    • Prescription drug pricing
    • Unfair or deceptive marketing practices
    • Opioid industry settlements
  • DOJ criminal and civil antitrust and fraud enforcement in health care
  • FTC merger review and overview of cases conducted in health care markets
  • DOJ and FTC enforcement guidance in health care markets
  • Strategies for protecting your organization under today’s aggressive enforcement conditions
