As artificial intelligence usage continues its explosive growth, the United States Congress, federal agencies and state legislators alike have sprung into action, proposing and adopting various new pieces of legislation aimed at safeguarding individuals’ rights against so-called “digital replicas.” These bills—including the Nurture Originals, Foster Art, and Keep Entertainment Safe (“NO FAKES”) Act of 2024; Tennessee’s Ensuring Likeness, Voice, and Image Security (“ELVIS”) Act of 2024, and more—are changing the legal landscape around privacy and rights of publicity at a rapid rate.
