Privacy Considerations in an Era of New Health Data Custodians

Learn How Seismic Changes in the Collection, Exchange and Use of Health Data Are Impacting Privacy—and Outpacing Policy—at a New Manatt Webinar.

Over the past decade, the ways we gather, share and use health data have been transformed. There has been tremendous progress in the adoption of electronic health record (EHR) systems by hospitals and health care providers, coupled with new standards to facilitate the electronic exchange of patient health information among providers and, through app-based technologies, increasingly with third parties or directly with patients. In addition, aggregating and mining large patient data sets for insights to improve care and reduce costs has become a focus for traditional health care players and new market entrants alike.

At the same time, the Internet, smartphones and tablets have become ubiquitous, creating opportunities for new ways to obtain, organize, use, store, combine and analyze consumer data, including health information. In most cases, technology and data analytics developments are outpacing the policy and regulatory processes that govern the collection and exchange of health information and seek to ensure basic consumer privacy protections.

In a new webinar—the final program in our “Ten Health Care Imperatives for the Decade Ahead” series—Manatt Health explores how data use and privacy considerations are being reshaped as the digital flow of health information becomes an essential component of the health care ecosystem. The webinar will answer key questions, including:

  • Who are the new (health+) data custodians?
  • How are they seeking to use, and in many cases commercialize, health data?
  • What makes recent market developments stand out from past health data use efforts?
  • What key policy and legal questions will the industry have to grapple with over the coming months?
  • What are the implications for privacy—and the next steps for ensuring protections are in place?
