Reilly Quoted by Cybersecurity Law Report About Industry Impact of CPPA’s Enforcement Action Against Honda
Manatt Privacy and Data Security Partner was quoted in Cybersecurity Law Report discussing the California Privacy Protection Agency’s (CPPA) settlement with Honda regarding alleged privacy rights violations and how the action may impact companies across industries.
The CPPA’s six-figure fine against Honda was based on allegations that the company required customers to provide excess personal information and created a difficult process for them to opt out of sharing their data. “[The Honda matter] can be seen as demonstrating a roadmap for the CPPA to scale its investigative and enforcement powers by prioritizing readily apparent findings that are relatively easy to prove,” Reilly said. User interface design, particularly surrounding opt out options, is one area that could be easily investigated since they are public on websites and apps. If violations such as asymmetry in consumer choice for opting in versus opting out of data sharing are found, the CPPA could pursue enforcement action, Reilly noted.
