Reilly Quoted in Bloomberg Law About CPPA’s Enforcement Penalty for Consumer Privacy Violation
Manatt Privacy and Data Security Partner was quoted in a Bloomberg Law article exploring the impact of the California Privacy Protection Agency’s (CPPA) enforcement penalty against an automaker for allegedly violating consumers’ data privacy.
This first enforcement action by the CPPA follows findings that the auto company made the process harder for consumers to opt out of sharing data and required more information than necessary. As the penalty may be a message for businesses in all industries, companies should ensure they are complying fully with privacy data rules, Reilly said. While no harm to the consumers were identified from the case, the CPPA still enforced the penalty, showing that consumers need to be able to exercise their rights, according to Reilly. “All of this is an expression that ‘We think if you violate these requirements, that that, in and of itself, is a harm,’” Reilly said. “These are harms that do not need to be quantified in terms of actual damage, whether that’s monetary damage or psychological damage.”
