White House Option for Virus Response Could Set Legal Precedent

Manatt Health managing director Jocelyn Guyer spoke with Bloomberg Law about how the President’s declaration of a national emergency has provided states with greater flexibility in their Medicaid programs through the use of 1115 and 1135 waivers. In the article, Guyer notes that while last week’s emergency designation provides states with more flexibility, it is ultimately up to states to make use of those new options. She stated that the Trump administration is “sending signals that they really want states to use [these options]” and that they needn’t fear “nitpicky program oversight” requirements.
