A Manatt team led by Entertainment Litigation Partner Nathaniel Bach successfully secured a dismissal in the U.S. District Court for the Northern District of California of X Corp.’s (fka Twitter) claims against the European Climate Foundation, an EU-based climate non-profit. The lawsuit, X Corp v. Center for Countering Digital Hate Inc., et al., claimed that ECF (and co-defendant CCDH) violated the Computer Fraud and Abuse Act and tortiously interfered with X Corp.’s contract with a third party when the defendants were engaged in newsgathering and reporting activities. District Judge Charles Breyer granted ECF’s motion to dismiss both for lack of personal jurisdiction over ECF and for failure to state a claim.
