Pearson Quoted by American Banker on Courts’ Role in Supervising the Executive Branch and CFPB

Manatt Financial Services Partner  was quoted in an article by American Banker discussing whether the president can “faithfully” enforce a law made by Congress without interference from the courts, a question raised in the legal battle between the current administration’s Consumer Financial Protection Bureau (CFPB) and the National Treasury Employees Union.

Through the president’s efforts, the CFPB’s acting director and chief legal officer aimed to fire most of the bureau’s employees through a reduction in force, which was halted by an injunction issued by the District Court Judge. This case is currently in the appellate court where the panel will decide whether the judge erred in issuing the injunction and if it inappropriately intruded on the executive branch’s control of the CFPB. According to Pearson, the administration’s stance is that the courts “have no role in supervising the executive branch or the day-to-day operations of an agency.”
