Manatt provided corporate and regulatory counsel to startup Medicare Advantage health plans Astiva Health, Inc., and Brandman Health Plan, Inc., as they obtained the financing, Knox-Keene licenses and Centers for Medicaid & Medicare Services contracts needed in order to officially launch in California on January 1, 2021.
The firm’s representation of Astiva Health included creating a startup private equity fund structure, completing a private placement raising more than $25 million, advising the plan on all aspects of Knox-Keene licensure requirements, preparing and submitting license applications, and providing the critical regulatory counsel before CMS and the California Department of Managed Health Care needed to ensure a successful launch. The firm represented Brandman Health Plan before the DMHC and CMS, and advised on structuring, network development, MSO services, regulatory, and corporate and tax exemption issues.
